(2) Petitioner was granted licence for retail sale of country liquor during Financial Year 2022-23. By means of this writ petition, petitioner has sought the following relief: “a) Issue a writ, order or direction in the nature of Mandamus directing the respondents to issue the requisite permits for uplifting the Country Liquor against the quota of the financial year 2022-23 against which the amount of Rs. 2,00,35,814/- (Rs. 1,02,59,776/- with respect to Nainital Road Haldwani Shop and Rs. 9776038/- with respect to Railway Road Shop) is already deposited with the department of excise.” (3) Learned State Counsel points out that after Financial Year 2022-23, petitioner was not granted any licence. He submits that the prayer was made to lift the country liquor against the quota of Financial Year 2022-23 and upon expiry of the said financial year, the relief as claimed do not survive. (4) This Court finds substance in the submission made by learned State Counsel. The relief as claimed do not survive due to efflux of time. Accordingly, writ petition is dismissed.
