AT CHANDIGARH **** 119 CR-3138-2025 Date of Decision.:22.05.2025 Sukhchain Singh Pe%%oner Vs. Nirmal Singh Respondent
CORAM:
HON’BLE MR. JUSTICE DEEPAK GUPTA Present: Mr. Ramesh Sharma, Advocate for the peoner. **** DEEPAK GUPTA, J. (ORAL) Peoner assails order dated 06.05.2025 (Annexure P-3) passed by learned Civil Judge (Junior Division), Nakodar, whereby objecons filed by him in Execuon Case No.1 of 2024 had been dismissed. Suit for recovery of `2,72,000/- along with interest filed by plainff Nirmal Singh (decree-holder/respondent herein) was decreed on 28.04.2022. The suit was based upon pronote and receipt. Execuon was filed in which the peoner/judgment-debtor raised objecon that alleged pronote was the result of fraud and that he had not borrowed any amount. The Execung Court has rightly dismissed the objecon by observing that the Execung Court cannot go behind the decree and that the
judgment-debtor had already contested the ma9er. This Court does not find any illegality or perversity in the impugned
order. As such, holding the present peon to be devoid of any merit, same is hereby dismissed.
