HIGH COURT OF JUDICATURE AT ALLAHABAD CIVIL MISC REVIEW APPLICATION No. - 211 of 2025 Court No. - 50 HON'BLE AJAY BHANOT, J.
Order on Correction Application: Some typographical errors were pointed out in the order dated 06.03.2025 passed in Writ-A No.2904 of 2025 (Kamal Pathak v. Union of India and 2 others). The correct order shall read as under:
“Shri Bipin Pal Singh, learned counsel appears for the petitioner. The petitioner has sought the following relief:
"(i) To pay the salary allowances, P.F. including interest from the date of compulsory retirement i.e. from 12.09.2006 to 27.05.2011." Admittedly, the petitioner was compulsory retired on
12.09.2006. The petitioner was later reinstated in service pursuant to an award of the labour court. According to Ms. Archana Singh, learned counsel for the respondents No.2 and 3, the award of the labour court has been duly executed. The petitioner is effectively seeking reliefs which were not granted by the labour court. The petitioner cannot claim something which was not granted by the labour court nor agitated by him at the time of execution of the award of the labour court. The delay of almost 14 years in approaching the Court is fatal to the case of the petitioner. The writ petition is dismissed for the above reasons as well as for the delay and laches." Versus Counsel for Applicant(s) : Bipin Pal Singh Counsel for Opposite Party(s) : A.S.G.I., Archana Singh, Prem Narayan Rai Kamal Pathak .....Applicant(s) Union of India And 2 Others .....Opposite Party(s)
Order on Review Application:
1. Heard Shri Ajay Srivastava, learned counsel holding brief of Shri Bipin Pal Singh, learned counsel for the review-petitioner, Shri Prem Narayan Rai, learned counsel for the respondent No. 1 and Ms. Archana Singh, learned counsel for the respondent No. 2 and 3.
2. The petitioner has stated that he has not been paid his salary allowances, P.F. including interest from the date of compulsory retirement from 12.09.2006 to 27.05.2011.
3. The only ground of review of review is that the petitioner was not paid his salary allowances, P.F. including interest from the date of compulsory retirement from 12.09.2006 to 27.05.2011.
4. The aforesaid issue had been dealt with in the order passed by this Court.
5. No error apparent on the record before this Court has been established from the arguments made on behalf of the petitioner.
6. The review is essentially a barely disguised attempt for a rehearing of the matter. This Court is flooded with litigation. The docket of the Court is always outsized. In case applications for repeated hearings are filed at the drop of the hat in the guise of review applications, administration of justice would become nigh impossible.
7. The petitioner is directed to deposit Rs. 10,000/- as costs to be recovered by the District Magistrate, Bijnor as arrears of land revenue. Compliance affidavit to be filed by the District Magistrate, Bijnor in the office of Chief Judicial Magistrate, Bareilly.
8. The writ petition is dismissed.
9. The Chief Judicial Magistrate, Bareilly shall communicate the same to the learned Registrar General of this Court. The above proceedings shall be completed within a period of two months.
