Senthil Kumaraiah For R1 : Mr.R.Meenakshi Sundaram, Additional Public Prosecutor For R3 : Mr.S.V.Gowtham O R D E R The present Petition has been filed by the sole accused in Spl.S.C.No.201/2022 pending on the file of Special Court for Exclusive Trial of Cases under POCSO Act, Madurai seeking to quash the charge sheet, wherein, the Petitioner is charged for the offence under Section 9 of Prohibition of Child Marriage Act, 2006 and Section 5(l), 5(j)(ii) and 6 of POCSO Act, 2012 and Section 366 of IPC. 2.The victim girl was born on 8.6.2005.She had attained majority on 8.6.2023.Thereafter she had married the sole accused on 14.6.2023 and the marriage has been registered before the Sub Registrar, Usilampatti on
25.11.2025. 3.The defacto complaint was present before this Court on 2/5 https://www.mhc.tn.gov.in/judis
Crl.O.P(MD)No.20123 of 2025 17.11.2025 and she submitted that she had arrived at a compromise and requested for quashing of the charge sheet. This Court adjourned the same for four weeks for production of the Marriage Registration Certificate. Therefore the matter is listed today. 4.A perusal of the records reveal that the sole accused has got married to the victim girl after she had attained majority and the marriage has also been registered and the Marriage Registration Certificate is produced before this Court. The parties have also filed a Joint Compromise Memo to that effect. 5.Considering the fact that they have settled the issue between themselves and leading a peaceful marital life, no useful purpose will be served in continuing the prosecution as against the Petitioner.
6.In view of the above facts, the charge sheet in Spl.S.C.No. 201/2022 pending on the file of Special Court for Exclusive Trial of Cases under POCSO Act, Madurai stands quashed and the Criminal Original Petition stands allowed.
