JUSTICE MA CHOWDHARY, JUDGE ORDER 03.01.2025 Petitioner through the medium of this petition seeks direction for expeditious disposed of bail application in case titled “Union Territory of J & K vs Abdul Ahad Waza”, arising out of FIR No. 69/2020 registered at Police Station Sumbal Bandipora, pending before the NIA Court (Additional District and Sessions Judge), Bandipora, under Sections 23, 39 ULA(P) Act and 7/25 of Arms Act. The learned counsel for the petitioner vehemently submits that, in the bail application pending before the trial Court, no effective proceedings have been taken and the bail application moved months back has not been attended to by the trial court, whereas, in the main case, the trial of the main case has been concluded and is posted for final hearing. Though, the petitioner has not placed on record any documents so as to suggest the pendency of the bail application before the trial court, however, in the interest of justice, this petition is disposed of at this stage with a direction to the trial court to consider the disposal of the bail application moved by the petitioner, if any, pending on its files, expeditiously, having regard to the fact that the main case is also for final consideration.
