JUSTICE VENKATESH NAIK T) Learned High Court Government Pleader is directed to take notice for respondent No.1 – State. 2. Heard the learned counsel for the petitioners and learned HCGP for respondent No.1 – State. 3. Petitioners have filed this petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (Section 482 of Cr.P.C.) to quash the entire proceedings in C.C. No.1448/2019 on the file of the learned Principal Civil Judge and JMFC, Gangavathi, Koppal District, registered for the offences punishable under Sections 341, 323, 353, 504, 506 of IPC. 4. The brief facts of the prosecution case are as under: On 29.10.2018 the complainant and his staff visited old Halebazar Madeshwar Temple at Gangavathi-Raichur road, Karatagi Taluk. At that time, these petitioners took quarrel - 4 - HC-KAR NC: 2025:KHC-D:8952 CRL.P No. 102778 of 2025 with the de facto complainant and his staffs, they wrongfully restrained them, voluntarily caused hurt, they obstructed CW1 from discharge of public duty and also insulted and made criminal intimidation to eliminate them. Hence, the de facto complainant lodged a complaint which led to registration of FIR and initiation of the investigation. 5. After completion of the investigation, the Investigating Officer filed the charge sheet against the accused for the aforesaid offences. Taking exception to the same, the petitioners have filed this petition. As per the material available on record, the Trial Court framed charges against the accused persons and the matter is set down for trial. 6. This aspect has not been disputed by the learned counsel for the petitioners. Therefore, framing of charges after filing of the charge sheet material signifies that, there is sufficient material against accused to proceed with the trial. Hence, there is no merit in this petition. Accordingly, the petition is dismissed. - 5 - HC-KAR NC: 2025:KHC-D:8952 CRL.P No. 102778 of 2025 However, considering the age of the litigation, it is just and necessary to direct the Trial Court that the matter shall be disposed off as expeditiously as possible.
