Petitioners have been made accused in connection with Nagar Untari P.S. Case No. 241 of 2024 for the offences registered under sections 274, 275, 292, 338, 336(3), 111 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 47(A) of Excise Act, pending in the court of learned Additional Chief Judicial Magistrate, Nagar Untari, Garhwa. 3. On 05.12.2024, Nagar Untari Police intercepted a container bearing registration no. UP 21 ET 0940 and seized huge quantity of liquor from there. It is alleged that the petitioners and co-accused persons were escorting the said vehicle. 4. Learned counsel appearing on behalf of the petitioners submitted that the petitioners have become the victim of circumstances as they were present at the place of occurrence at wrong time. It was further submitted that the petitioners have not no criminal antecedent and this fact has been mentioned at paragraph-15 of this bail application. 5. In view of the submission made above, I am inclined to enlarge the petitioners on bail. Accordingly, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) each, with two sureties of the like amount each, to the satisfaction of Additional Chief Judicial Magistrate, Nagar Untari, Garhwa in connection with Nagar Untari P.S.
