IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.12274 of 2025
Guru Pangi @ Rabi … Petitioner Mr. B.R. Tripathy, Advocate -versus- State of Odisha … Opposite Party Mr. P. Satpathy, Addl. PP
CORAM: JUSTICE G. SATAPATHY
Order No.
ORDER(ORAL): 07.03.2026
03. I.A. No.1095 of 2025
1. In view of the submission as advanced for the petitioner, the IA No.1095 of 2025 filed for interim bail stands disposed of as not pressed. BLAPL No.12274 of 2025
2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Nandapur PS Case No.41 of 2023 corresponding to CT Case No.108 of 2023 pending in the file of learned Additional Sessions Judge-cum-Special Judge, Koraput, for commission of offences punishable U/Ss.302/201 of IPC, on the main allegation of committing murder of the daughter of the informant. 3. Heard, Mr. Biswajit Ranjan Tripathy, learned counsel for the petitioner and Mr. P. Satpathy, learned Additional Public Prosecutor in the matter and perused the record including the copy of depositions of PWs.5 to 8 as supplied. 4. The petitioner renews his prayer for bail purportedly under the changed circumstance of examination of material witness of PW7-Jhunu Harijan, who has not supported the prosecution allegation against
the petitioner. The last bail application of the petitioner was rejected by this Court by mainly considering the statement of witness Jhunu Harijan and the availability of CCTV footage, but after examination of Jhunu Harijan, who has not supported the prosecution allegation against the petitioner; it appears to the Court that the petitioner has made out some ground for grant of bail. In the aforesaid backdrop and taking into consideration the materials placed on record and there being no direct evidence available against the petitioner vis-à-vis the pre-trial detention of the petitioner in custody since 13.05.2023 and trial having not yet been concluded with examination of only 8 out of 19 shortlisted witnesses and, thereby, the trial would take some more time for conclusion, this Court without expressing any view on merits admits the petitioner to bail. 5. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 6. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules.
A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G. Satapathy)
