JUSTICE BISWAJIT PALIT Order 30.01.2026 Learned counsel Mr. Arjun Acharjee, appears on behalf of the petitioner and Mr. Agniva Chakraborty, learned counsel appears on behalf of the respondent. The petitioner has challenged the order dated 02.04.2024 passed by learned Judge, Family Court in Crl. Misc. No.106/2022. It appears from the order dated 02.04.2024 that by the said order the OP-husband was asked to pay for Rs.4,500/- per month to the petitioner from the month of March, 2024 and with further direction to pay the amount to the bank account of the petitioner wife. In the first part of the order it was also mentioned that as per affidavit the petitioner shall have the right to file petition for enhancement of maintenance allowance in future against the OP. It is the settled position of law that for enhancement of maintenance allowance, it is always open for the petitioner to 2 approach by filing petition to the competent Court in accordance with law. It is not clear to this Court why the petitioner has filed this petition before this Court seeking reliefs. At this stage, learned counsel for the petitioner prays for allowing him to withdraw the same and to file the petition before the competent Court. No liberty can be granted. However, it is the settled position of law that in case of variation of monthly income the petitioner can approach the competent Court. Accordingly, the present petition filed by the petitioner stands disposed of, being not pressed by the petitioner. The case thus stands disposed of.
