Present petition has been filed challenging the order dated 01.05.2025 passed by Additional District Magistrate (Finance & Revenue), District Auraiya, debarring the petitioner from mining in future and directing him to deposit Rs.5 lakh as penalty imposed on him for indulging in illegal mining. 2. The source of power to pass the order dated 01.05.2025 can be traced to Rule 61(3) of the U.P. Minor Minerals (Concession) Rules, 2021 (hereinafter referred to as "the Rules, 2021"), therefore, the petitioner has the remedy of filing an appeal under Rule 79 of the 'Rules 2021'. 3. In view of above, the petition is dismissed on the ground of availability of alternative remedy. 4. Petitioner may exercise alternative remedies available to him under the law.
