1. By way of this petition, the petitioner has prayed for following reliefs:-
2. Learned counsel for the petitioner submits that the petitioner is presently suffering from a severe medical ailment, which has
3 substantially impaired his physical capacity to perform the standard eight-hour duty mandated by his employment. It is contended that, owing to his fragile health condition, the petitioner is unable to discharge prolonged duties without risking further deterioration of his wellbeing.
Counsel further submits that, through the present petition, the petitioner seeks a direction to the competent authority to consider his case with due sympathy and humanitarian consideration, and to permit him to render services for a reduced duration, not exceeding eight hours, until such time as he fully recovers from his ailment and is medically fit to resume regular duties. 3. On the other hand, learned counsel for the respondents submits that the petitioner is first required to submit an appropriate and duly detailed representation before the competent authority, so that the authority may properly examine his grievances in accordance with law and take a reasoned decision; therefore, without such representation having been made and considered, the present petition is premature and not maintainable. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Considering the overall facts and circumstances of the case, and taking into account the submissions made by the parties, this Court deems it appropriate to direct the petitioner to submit a comprehensive and duly supported representation before the
4 competent authority, enclosing all relevant documents necessary for proper adjudication; and, in turn, the concerned authority shall consider and decide such representation strictly in accordance with law, within a reasonable period, by passing a well-reasoned and speaking order. 6. It is hereby clarified that this Court has not expressed or formed any opinion on the merits of the case at this stage. 7. With this observation and direction, the writ petition is disposed of.
