This appeal is directed against the order dated 28.01.2025 passed by learned Sessions Judge, Palamau in B.P. No. 35 of 2025 in connection with AHTU P.S. Case No. 01 of 2025, whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been alleged that the appellant was apprehended with four minor children and four major boys who were being taken for the purposes of human trafficking. Submission has been advanced by the learned counsel for the appellant that relatives of some of the minors had already given an affidavit before the Investigating Officer that the appellant was taken them for giving them work at their request. It has been submitted that the appellant is in custody since 02.01.2025. Learned A.P.P. has opposed the prayer for bail of the appellant. Regard being had to the fact that there is no allegation of any exploitation of the minor victims apart from the affidavits which have been filed on behalf of some of the relatives of the victims, we while setting aside the order dated 28.01.2025 passed by learned Sessions Judge, Palamau in B.P. No. 35 of 2025 in connection with AHTU P.S. Case No. 01 of 2025, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Palamau in connection with S.T. Case No. 201 of 2022 arising out of AHTU P.S. Case No. 01 of 2025. This appeal stands allowed and disposed of. (RONGON MUKHOPADHYAY, J.) MK (AMBUJ NATH, J.)
