JUSTICE M.NAGAPRASANNA) 1. The petitioner is before this Court seeking the following prayer: i. Issue Writ of Certiorari, quashing the recruitment published in website with reference no. Sankya.Shi.Aa.Yo.Ba/Aum.Sa /Prakatane/2016-17 dated 06/02/2017 as per Annexure E by respondent no. 3 by issuing writ in the nature of certiorari concerned to the Sl. No. 19 Ward no. 22 Centre No. 16, Near Mailaralingeshwara khanavali, Bagalkot. ii. Directing the Respondent No. 3 to consider the representation dated 21/02/2017 as per Annexure G. iii. Pass such other orders or direction as this Hon’ble Court deems just and proper under the facts and circumstances of the case, in the interest of justice and equity. 2. Heard the learned counsel Sri.Y.R.Jogi, appearing for petitioner and learned HCGP-Smt.Girija S. Hiremath, appearing for respondents. - 3 - HC-KAR NC: 2025:KHC-D:17772 WP No. 102323 of 2017 3. The petitioner is said to have been appointed as an Anganwadi Assistant at Sector-38 Navanagar, Bagalkot jurisdiction. The petitioner then is said to have submitted a representation seeking continuation in the post without calling for fresh applications. Notwithstanding the same, a recruitment publication comes about on 16.02.2017. The petitioner challenges the said recruitment notification for appointment of Anganwadi Assistant on the score that she belongs to the Scheduled Caste category and that the post ought to have been reserved for Scheduled Castes. It is contended that permitting general merit candidates to participate in the recruitment process is contrary to law. 4. The learned HCGP submits that the recruitment process has already taken place and one Saraswati has been appointed as Anganwadi Helper in the said Anganwadi Center. The learned HCGP would further submit that the petitioner contested elections, was elected as a Municipal Member and after completion of the term as Municipal Member now seeks to return to the post, which is impermissible in law as somebody else is already working in the post. - 4 - HC-KAR NC: 2025:KHC-D:17772 WP No. 102323 of 2017 5. In that light, the petition does not deserve any indulgence and stands disposed without interfering with the impugned order. Ordered accordingly.
