1. Following relief has been claimed in this writ petition - i. To kindly set aside the impugned order dated 16/08/2021 (Annexure P/1) and direct the respondent No.2 to release the subsistence allowance to the petitioner from January 2021 (except June). ii. To kindly direct the respondent No.2 not to further harass the petitioner and not to violate the fundamental right to life guaranteed under Article 21 of the Constitution of India which includes payment of subsistence allowance during suspension period.
2 iii. To kindly make any other order that may be deemed fit and just in the facts and circumstances of the case including awarding of the costs to the petitioner from the respondent No.2.

Learned counsel for the petitioner submits that the petitioner who was working as Assistant Engineer with the respondent/C.G.Police Housing Corporation Ltd. was placed under suspension vide order dated 11/09/2017 on account of filing of charge sheet under Section 13 (1) Ã, 13 (2) of Prevention of Corruption Act, 1988 before the competent Court. He was being paid subsistence allowance however impugned communication dated 16/08/2021 was issued in which the petitioner was directed to make his attendance at head quarter at Raipur so that the subsistence allowance could be continuously paid to him. He submits that the petitioner went to Raipur head quarter of the respondents, however his joining was not taken. Therefore, the writ petition was filed and this Court while issuing the notices of the respondents, also expected that the subsistence allowance should not be discontinued. Therefore, as the petitioner was not allowed join at the Police Head Quarter, Raipur, the impugned order may be set aside.
3. Opposing the above submission, learned counsel for the respondents submits that the petitioner is being regularly paid subsistence allowance and according to his instructions, the petitioner is presently posted at Raipur head quarter.

As submitted by learned counsel for respondent No.2 that the petitioner is presently under suspension and is posted at police head quarter of respondent No.2 at Raipur and he is being paid subsistence allowance, therefore, there is no necessity in keeping this writ petition pending. Accordingly, this writ petition is
