1. Heard on I.A. No.01/2025, application for condonation of delay in filing of instant M.C.C.

2 therefore, Arbitration Appeal No.32 of 2015 was dismissed on 03.09.2025 for want of prosecution, as counsel for the applicant also could not appeared. He further submits that the non appearance of applicant/appellant was bonafide and there is delay of only 32 days. Hence, he prayed that instant M.C.C. may be allowed by condoning the delay in filing the instant M.C.C.

Learned counsel for the respondent raised objection.
4. On due consideration and for the reasons mentioned in the application which is supported by an affidavit, delay of 32 days in filing the instant M.C.C. is condoned, consequently, I.A. No.01/2025 is allowed.
5. Also heard on M.C.C., application for restoration of ARBA No.32 of 2015, which was dismissed vide order dated 03.09.2025 for want of prosecution.

Learned counsel for the respondent raised objection.
7. On due consideration and for the reasons mentioned in the restoration application, instant MCC is hereby allowed.
