1. This Writ Petition has been filed for the following reliefs:-
"10.1 That, the Hon'ble Court may please to call for the entire records pertaining to the case of the petitioner. 10.2 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to release retiral benefits including the increment and other consequential benefit to the petitioner since 1990-91. Digitally signed by AJAY KUMAR DWIVEDI DN: cn=AJAY KUMAR DWIVEDI, ou=HIGH COURT, o=HIGH COURT OF CHHATTISGARH, st=Chhattisgarh, c=IN Date: 2025.11.20 16:49:15 +0530
2 10.3 That, the Hon'ble Court may kindly be pleased to direct the respondent authorities to decide the pending representation of the petitioner within stipulated period of time. 10.4 That, this Hon'ble Court may further be pleased to pass any other order in favour of the petitioner as it may deem fit and proper under the facts and circumstances of the case with cost."
2. At the outset, learned counsel for the petitioner submits that though certain retiral benefits have extended to the petitioner, however, his limited grievance is that the punishment which has been imposed upon the petitioner has been quashed by the order dated 29.10.2012 (Annexure-P/6) and order dated 28.12.2002 by which one increment was withheld during the departmental enquiry in the year 1990 for non- commutative effect has also been set-aside. However, the State Authorities have not yet given benefit of said order and arrears to the petitioner. Learned counsel submits that at this juncture this petition may be disposed of with a direction to grant arrears and other benefits to the petitioner as punishment has already been set-aside. The liberty may also be given to file fresh representation before the Authorities in this regard and Authorities may be directed to decide the same in an expeditious manner.
3. Learned State counsel would not oppose the aforesaid limited prayer to decide the representation.
4. Having regard to the submission of learned counsel for the parties, particularly, considering the fact that punishment imposed upon the
3 petitioner has already been set-aside, it is expected from the concerned Authorities to examine the case of the petitioner and release the arrears in an expeditious manner in accordance with relevant rules/law. Further, if the petitioner files a representation within a period of 30 days from this
order raising the aforesaid grievances, the same shall be decided by the concerned Authority in an expeditious manner within outer limit of six months from the receipt of such representation. Ordered accordingly.
5. With the aforesaid direction/observation, this petition stands disposed of. Sd/-
