The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking quashing of FIR No. 249/2020 registered at Police Station Maidan Garhi, Delhi, under Sections 498A/406/34 of the Indian Penal Code, 1860, and all consequential proceedings arising therefrom. 3. Briefly stated, the marriage between petitioner no. 1 and respondent no. 2 was solemnized on 04.12.2013. Due to matrimonial disputes, the parties started living separately from 30.10.2017. Thereafter, respondent no. 2 lodged FIR No. 249/2020 at P.S. Maidan Garhi under Sections 498A/406/34 IPC alleging cruelty and dowry-related offences. Subsequently, the parties amicably settled their disputes before the Mediation Centre, Saket Courts, leading to the filing of the present petition seeking quashing of the FIR and all consequential proceedings. 6. During the pendency of the proceedings, the parties amicably settled all their disputes through a Mediation Settlement dated 15.03.2023, whereby they agreed to dissolve their marriage by mutual consent and settle all claims, including maintenance, permanent alimony and stridhan, for a total sum of ₹4,00,000/- payable in four instalments. 7. On a query made by this Court, Respondent No.2, who has been duly identified by the IO, categorically states that she has entered into the settlement out of her own free will, without any force, coercion or undue influence. She further states that the entire settled amount has been received by her and that she has no surviving claim whatsoever against the Petitioners. She has no objection if the present FIR and all proceedings emanating therefrom are quashed. 8. In view of the fact that the parties have amicably resolved all their disputes, the marriage already stands dissolved by a decree of divorce by mutual consent, the entire settlement amount has been paid, and Respondent No.2 has no objection to the quashing of the FIR, no useful purpose would be This is a digitally signed order.
