Petitioner has filed this writ petition seeking following reliefs: “10.1 To call for the records of the case for the kind perusal of this Hon'ble Court. Digitally signed by PRAVEEN KUMAR SINHA Date: 2025.11.28 11:05:28 +0530 2 / 3 10.2 This Hon'ble Court may allow the writ petition and to issue appropriate writ and to direct respondent authorities to restrain from making illegal construction mainly wall around karbala talab pond, From Panchmukhi Hanuman Mandir to Jain Mandir Choubey colony, ward no 39 swami Atmanand ward Raipur in the interest of justice. 10.3 This Hon'ble Court may in alternate direct the respondents to leave enough space for path way for the petitioners and to construct fencing instead of construction of wall. 10.4 Any other relief deemed fit in the facts and circumstances of the case may also be granted.” 2. Learned counsel for the petitioner submits that respondent No.1/Municipal Corporation is raising boundary-wall on the bank of pond by which access to house of the petitioner will be blocked. Petitioner has already submitted representation before respondent authorities on 17.07.2025, however, till date respondents have not taken any decision on it and therefore a direction be issued to concerned authority to take decision on representation submitted by petitioner at the earliest . 3. Learned counsel for respondents submit that as the petitioner is not pressing this writ petition on merits and only seeking a direction to respondents to take decision on pending representation, they are having no objection. If the representation of the petitioner is still pending consideration it will be considered and decided in accordance with law. 3 / 3 4. I have heard learned counsel for the parties and also perused documents annexed along with writ petition. 5. Considering the submission of learned counsel for the parties, this writ petition at this stage is disposed off directing respondent No. 1 & 2 to take decision on representation submitted by the petitioner dated 17.07.2025 (Annexure P-3) in accordance with law, expeditiously, preferably within a period of 1 month from the date of receipt of copy of this order.
