Mr. Shubham Pandey, learned counsel for the applicant. 2. Mr. Pankaj Joshi, learned A.G.A. for the State. 3. Present applicant Khushbu, W/o Monees is praying for bail in relation to FIR dated 11.02.2025, bearing FIR No. 37 of 2025 registered at P.S. Banbhoolpura, District Nainital wherein present applicant and one Sazia, real sister of the applicant, were implicated for the offence punishable under Section 306 IPC. 4. It is contended by the learned counsel for the applicant that applicant is innocent and has been falsely implicated which is evident from the fact that the alleged incident was happened on 03.06.2024 but the FIR was lodged almost after eight months, i.e., on 11.02.2025. Apart from this, he submits that there is no allegation of any instigation. He further submits that present applicant is a house wife and is languishing in jail since 02.03.2025, and, since charge sheet has already been filed therefore there is no need of custodial interrogation of the applicant. 5. On the other side, Mr. Joshi, learned A.G.A. has not disputed this fact that charge sheet has already been filed, and, as such, there is no need of custodial interrogation of the applicant. 6. After hearing the arguments of the learned counsel for the parties and taking into consideration that the charge sheet has already been filed, and, as such, there is no need of custodial 2025:UHC:6366 interrogation of the applicant, this Court is of the view that the applicant deserves for bail. 6. Accordingly, without expressing any opinion on the merits of the case, the bail application is allowed. 7. Let the applicant Khushboo be released on bail on her executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
