Order on Board 27/01/2025
1. By way of this petition, the petitioner has prayed for following reliefs:-
“10.1 That, this Hon'ble Court may kindly be pleased to quash impugned order of transfer dated 17.01.2025, (Annexure P-1) (so far as concerned to the petitioner and respondent No.-3), passed by the respondent No.- 1.”
2. Learned counsel for the petitioner submits that the petitioner is working as Sub Divisional Officer, Irrigation Project, Sub-Division- Arang, District-Raipur, Chhattisgarh and has been transferred from office of Sub-Divisional Officer, Irrigation Project, Sub Division-Arang, District-Raipur, Chhattisgarh to office of Superintend Engineer, Mahandai Circle, Raipur, District-Raipur, Chhattisgarh. He further submits that the respondent No. 4 who is an election officer appointed to the petitioner as Assistant Returning Officer to the petitioner for the forthcoming election of Local Bodies, 2025, and petitioner is engaged in the election work, which is important work of State. He further submits that on
3 the said ground he is challenging the transfer order, as such the transfer order is not in accordance with law and requires to be quashed.
3. On the other hand, learned counsel appearing for the State opposes the submission and submits that the transfer order has rightly been passed which is not required to be interfered with.
4. I have heard learned counsel for the parties and perused the material available on record.
5. Considering the submissions made by the parties and looking to the fact that the petitioner is engaged as Assistant Returning Officer for the forthcoming local bodies election as such the transfer order is kept in abeyance till 20th February, 2025.
6. The petitioner is directed to join his place of posting on 25th February, 2025.
7. With this observation and direction, the instant petition stands
