ORAL ORDER (PER: THE HON'BLE MR. JUSTICE M.NAGAPRASANNA)
1. The petitioner is before this Court seeking the following prayer:
A. Issue a writ in nature of mandamus or such other appropriate direction to the respondent no. 3 and 4 to consider the e- Tender dated 04-06-2023 vide Annexure-C, submitted by the petitioner, concerning tender Reference no.
BPCL/RETAILPOL/ BULK/DESUR/2023-28 bearing e-tender id 11877 published by 3rd respondent vide Annexure-A and issue letter of intent to the petitioner in the interest of justice and equity. B. Pass such other and further orders as this Hon’ble Court deems fit to pass in the interests of justice and equity. 2. Heard the learned counsel for the petitioner, learned CGSC and the learned counsel appearing for respondent Nos.2 to
4. 3. The petitioner is a participant pursuant to E-tender notified by respondent No.3 for transportation of bulk petroleum fuel, from Desur depot to various parts of the State. The petitioner is said to have been declared technically qualified for the said transportation. But no steps are taken further, to the said qualification. - 4 -

4. The learned counsel Sri. C.V. Angadi appearing for respondents Nos.2 to 4 would submit that if reasonable time is granted, the application of the petitioner would merit
consideration in strict consonance with law and appropriate orders would be passed thereon.
5. In the light of the said submission. I deem it appropriate to dispose the petition with a direction to respondent Nos.2 to 4 to consider the application submitted by the petitioner pursuant to the tender within an outer limit of eight weeks from the date of receipt of the copy of the
order, if not earlier.
