(Oral) The applicant is in judicial custody in FIR No.417 of 2023, dated 29.09.2023, under Sections 8/22/60 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Raipur, District Dehradun. This is the second bail application of the applicant. His first bail application has already been rejected on 04.06.2024. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. Learned counsel for the applicant would submit that the entire case is false; in the Arrest Memo, the FIR number has been recorded, which was lodged much after the alleged recovery. 4. Learned State Counsel admits that the Arrest Memo records the FIR number. 5. The Court posed a question, how is it possible? He submits that there is no document to explain it. 2 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
