Sahib Singh Vs. State of Himachal Pradesh & Ors. CWP No. 7397 of 2022 21.03.2025 Present: Mr. Sanjay Jaswal, Advocate, for the petitioner. Mr. Anup Rattan, Advocate General, Mr. Rajan Kahol, Mr. Vishal Panwar & Mr. B.C. Verma, Additional Advocate Generals, with Mr. Ravi Chauhan, Deputy Advocate General, for respondents-State. CMP No. 4239 of 2025 By way of instant application, prayer has been made on behalf of the applicants/ petitioners for bringing on record the LRs of deceased petitioner Mr. Sahib Singh, who has expired on 16.07.2024, leaving behind his L.Rs, as detailed in para 4 of the application. No reply is intended to be filed on behalf of non- applicants/respondents. Having perused the averments contained in the application, which is duly supported by an affidavit, this Court finds that deceased petitioner Mr. Sahib Singh has expired on 16.07.2024, leaving behind his LRs, as detailed in para 4 of the application. Since right to sue survives in favour of the applicants being LRs of deceased petitioner, there appears to be no impediment in accepting the prayer made in the application. Consequently, in view of the above, the present application is allowed and LRs as detailed in para 4 of the application are ordered to be substituted in place of deceased petitioner, whose name is otherwise ordered to be deleted from the array of parties. Registry to carry out necessary correction in the memo of parties on the basis of amended memo of parties annexed with the application. Application stands disposed of. CWP No. 7397 of 2022 Since applicants are represented by Mr. Sanjay Jaswal, Advocate, there is no necessity to issue notice to them. However, above named counsel may file Power of Attorney, if not already filed. Since pleadings are complete and parties are duly represented, let the case at hand be listed for final hearing in due course. March 21, 2025 (Sandeep Sharma), (sunil) Judge
