Heard learned counsel for the petitioner, learned counsel for the respondent and learned A.G.A. for the State respondents and perused the material available on record. 2. The present writ petition has been preferred with the prayer to quash the impugned First Information Report dated 20.02.2025, registered as Case Crime No.61 of 2025, under sections- 8/20/29/60 of NDPS Act, Police Station Lanka, District Varanasi and also not to arrest the petitioners in pursuance of impugned First Information Report. 3. Learned counsel for the petitioner submits that petitioner is not named in the FIR and his name surfaced only in the confessional statement of the co-accused. 4. Learned A.G.A. informs that police investigation is in progress. 5. Petition is disposed of directing that till cognizance is taken on police report under Section 173(2) Cr.P.C., by the court the respondents shall not arrest the petitioners pursuant to the aforementioned case, subject to cooperation in ongoing investigation.
