The present applicant ‘Irshad’ S/o Niyazullah is praying for regular bail in relation to First Information Report dated 30.01.2025 bearing FIR No. 29 of 2025 P.S. Gadarpur, District Udham Singh Nagar, which was lodged for the offences punishable under Section309(4) of BNS, 2023. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and furthermore the applicant have no previous criminal history. He further submits that the other co accused have already been enlarged on bail by the Trial Court. 5. On the written instruction, learned Deputy Advocate General Mrs. Pushpa Bhatt submits that during investigation the stolen articles were also recovered and on the confessional statement the accused also informed to the Investigating Officer that the ornaments have been sold out. 6. Mrs. Pushpa Bhatt, learned Deputy Advocate General, on written instructions apprise to this court that the applicant have a criminal history of one case with the same nature of allegation. So far as the bail order of the other co accused is concerned Mrs. Pushpa Bhatt submits that it relates to different Case Crime No. 79 of 2025, whereas, the applicant is praying for the bail in relation to Case Crime No. 29 of 2025. 7. Be that as it may, since the applicant have a criminal history of the same nature and there is recovery also, therefore, this court is of the view that the applicant does not deserve for bail. 8.
