CORAM:
HON’BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE.
ORDER 15.07.2025
1. On the request of the learned counsel for the parties, the case is taken out of turn.
2. The only grievance, which has been raised at this stage on behalf of the petitioners is that, while granting the registration to private respondent, i.e. M/s Glacier Gadkul Tata Sumo Owners Union, Sonamarg in estate Sonamarg, the petitioners be also heard by the competent authority.
3. On the contrary, the learned counsel appearing on behalf of the private respondent submits that he has got all the requisite NOCs from the competent authority and thus, the case is ripe for grant of registration in his favour. The instant petition is pending before this Court and the competent authority has not taken a final decision with regard to the registration of the taxi sumo stand, so no fruitful purpose will be achieved to keep the instant petition alive.
4. However, the petitioners are not averse to the disposal of the instant petition at this stage by taking a final decision vis-à-
vis the registration of the private respondent but while granting such registration, the petitioners submit that they should be given an opportunity of being heard.
5. With the consent of the learned counsel for the parties, the instant petition can be disposed of by directing the respondents 1 to 3 to take a final decision with regard to the registration of the private respondent No. 5 for private sumo stand at estate Sonamarg, within a period of six weeks from the date copy of this order along with the writ petition and annexures appended thereto are made available to the said respondents, in case the respondent No. 5 has fulfilled all the requisite formalities and there is no other legal impediment.
6. It is further made clear that while according registration in favour of the private respondent, all the stake holders including the petitioners be heard by the competent authority.
7.
Disposed of in the manner as indicated above.
