For Petitioner : M/s.W.Camyles Gandhi For Respondent : M/s.V.J.Priyadarsana Government Advocate (Crl.Side) 1/6 https://www.mhc.tn.gov.in/judis Crl.O.P.No.15630 of 2025 O R D E R The petitioner, who was arrested and remanded to judicial custody on 27.04.2025, for the alleged offences punishable under Sections 351(2) of BNS Act, Sections 11(iv), 11(v) r/w 12 of POCSO Act, 2012 and Sections 66E, 67, 67A of IT Act (506(i) of IPC) in Crime No.99 of 2025, on the file of respondent police, seeks bail. 2. The case of the prosecution is that defacto complainant's daughter/minor victim girl and the 1st accused were in love affair. It is alleged in the FIR that during the video call, the 1st accused asked the minor victim girl to share her nude video and she also shared her nude video. Thereafter, the 1st accused had taken a screenshot of nude photos of the victim girl. Thereby, the 1st accused threatened her to have sexual intercourse with him, failing which he will post her nude photos in social media. Hence, the case. 3.Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would submit that the petitioner has been in judicial custody from 27.04.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner. 4. Learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing for grant of bail to the petitioner, reiterated the prosecution case and submitted that there are totally two accused in this case and this petitioner is arrayed as A2. He also submitted that A1 and the victim girl were in love affair through instagram. Thereafter, A1 along with A2, who happens to be friend of A1, threatened the minor victim girl that they would publish her obscene photographs and video on social media. 5. Heard both sides and perused the materials available on record. 6. The petitioner is arrayed as A2. The 1st accused had developed relationship with the minor victim girl through instagram. The petitioner herein/A2 is a friend of A1. During video call, A1 has recorded the minor victim girls' nude video. Thereby, A1 along with A2 threatened the victim 3/6 https://www.mhc.tn.gov.in/judis Crl.O.P.No.15630 of 2025 girl to have sexual intercourse by threatening her that they would publish her obscene photographs and video on social media. Based on the complaint given through the child help line, the accused persons were arrested. A1 along with A2 is making all attempts to indulge in such heinous crimes luring victims through social media. The accused persons are believed to have enticed girls, who fall prey to their honey coated words. 7. Considering the submissions of the learned counsel on either side and also taking note of the gravity of the offence committed by the accused, this court is not inclined to grant bail to the petitioner. 8..
