Heard the parties.
The petitioner has been made accused in connection with Manatu P.S. Case No. 09 of 2025, corresponding to NDPS Case No.02 of 2025, for the offence registered under Sections 8B/18(B)/29 of the N.D.P.S. Act and Section 33 of the Indian Forest Act, pending in the court of learned Special Judge under NDPS Act, Palamau.
On 20.01.2025 at about 10:30 a.m, Manatu Police on the basis of confidential information that poppy was illegally cultivated at village Jaspur, went to the place of occurrence. On seeing the police party, petitioner and co-accused persons started fleeing away. The petitioner was apprehended at the place of occurrence.
It was submitted that petitioner was terrified on seeing the police personals and as such, he started fleeing away. It was also submitted that there is no witness who has named that the petitioner has actually cultivated the poppy plant. It was further submitted that petitioner has got no criminal antecedents.
Learned A.P.P on behalf of the State has opposed the prayer for bail.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge under NDPS Act, Palamau, in connection with Manatu P.S. Case No. 09 of 2025, corresponding to NDPS Case No.02 of
2025.
