THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 1119 OF 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A3 to A5, seeking bail, in Crime No.52/2024 of Pedabayalu Police Station, Alluri Sitharamaraju District 2. A case has been registered against the petitioners and another for the offences under Sections 111(2)(b) of B.N.S and 20(b)(ii)(C) r/w 25, 8(c) of the Narcotic Drugs and Psychotropic Substances Act. 3. Case of the prosecution, in brief, is that, on 28.10.2024 at about 3.30 pm, on receipt of credible information regarding illegal possession and transportation of ganja, the S.I of Police, Pedabayalu Police Station, along with staff and mediators, went to Kothaputtu junction road and started conducting vehicle checking. They found one Swift car coming from Kujabangi, and on seeing the police, three persons, including the Driver, got down from the car by stopping it and tried to escape. Then police apprehended them and on enquiry, the said three persons disclosed their identity particulars as that of A3 to A5 i.e. petitioners herein, and police found 130 kgs of ganja in their possession. Police seized the contraband and the vehicle, and arrested the accused and got them remanded to judicial custody on 28.10.2024. 4. Heard. Perused the record. 2 5. Learned Assistant Public Prosecutor submits that investigation is not yet completed and some more witnesses are to be examined and it is at nascent stage and prays to dismiss the Criminal Petition. 6. A perusal of the material available on record goes to show that the petitioners/A3 to A5 were arrested and got remanded to judicial custody on 28.10.2024, and the police, on credible information, seized 130 kgs of ganja, which is a huge quantity, from their possession. As stated by the learned Assistant Public Prosecutor that the investigation is at nascent stage. Hence, this Court is not inclined to grant bail to the petitioner at this stage as the quantity of contraband involved is a huge quantity. 8.
