Neutral Citation No. - 2025:AHC:121900 Court No. - 72 Case :- APPLICATION U/S 482 No. - 15154 of 2024 Applicant :- Ram Naresh Opposite Party :- State of U.P. and Another Counsel for Applicant :- Piyush Tripathi,Sheetanshu Dwivedi Counsel for Opposite Party :- G.A. Hon'ble Deepak Verma,J. 1. Heard learned counsel for the applicant and learned A.G.A. for the State. 2. The present 482 Cr.P.C. application has been filed to quash the non-bailable warrant dated 14.07.2023 passed by the Chief Judicial Magistrate, Sonbhadra in Case Crime No.1456 of 2011 (State vs. Keshaw Ram & others), under Sections 420, 467, 468, 471 I.P.C., P.S.Robertsganj, District Sonebhadra, pending in the court of Chief Judicial Magistrate, Sonebhadra. 3. The present application has filed with a prayer that non-bailable warrant has been issued despite order of this Court in regard to disposal of discharge application within four months and court has not decided the discharge application. 4. Considered the argument of both the parties. From the record, it is apparent that this Court in Application u/s 482 Cr.P.C.No.22409 of 2014 on 03.07.2014 has passed order that "in case, the applicant moves application for discharge through counsel before the concerned court below within a period of one month from today, the same shall be considered and disposed off as expeditiously as possible in accordance with law, by the concerned court below preferably within a period of four months thereafter." 5. The present application has filed in the year 2024 after about ten years of passing of the order dated 03.07.2024. The instant application is also not supported by any evidence that the applicant regularly appeared before trial court after submission of the court order. Application is not supported by any evidence which could show that on account of prosecution, discharge application could not be decided in stipulated time. No interference is warranted. 6. Hence, the application u/s 482 Cr.P.C. is dismissed. Order Date :- 24.7.2025 SKD Digitally signed by :- SURJIT KUMAR DEY High Court of Judicature at Allahabad
