THIS CRIMINAL PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
ORAL ORDER (PER: THE HON'BLE MR. JUSTICE S.RACHAIAH)
1. This is the successive bail application filed by the petitioner/accused No.4 for fifth time seeking regular bail on medical ground in Crime No.112/2019 of respondent-police for the offences under Sections 143, 147, 148, 448, 504, 506, 341, 307, 302, 324, 326, 120B and 201 read with Section 149 of the Indian Penal Code, 1860.

Learned counsel for the petitioner has filed a memo dated 27.11.2025 along with the medical documents pertaining to the petitioner. 3. Memo is taken on record. 4. The summary report of the petitioner regarding his health condition is as under:

“Mr. Krishna age 36 years, Hypertensive since 5 years on multiple anti hupertensive medication, now presented with complaint of giddiness and bleeding from the nose since 3 days, at presentation patient was in hypertensive urgency (190/100) other vitals were stable, systemic examination were within normal limits. Hemogram shows microcytic hypochromic blood picture (hb-12.5), renal function test, liver function test, lipid profile, thyroid function test, ESR, CRP, ABG were grossly normal, fundoscopy were within normal limits, 2d echo showed concentric left ventricular hypertrophy cardiology opinion was taken advised to continue same medication with tab Metoprolol. Patient was treated with antihypertensive medication and diabetic medication following which patient improved symptomatically blood pressure was in reducing trend patient is hemodynamically stable and being discharged with following advise.”
5. Pursuant to the order dated 20.11.2025 passed by this Court, the learned High Court Government Pleader for respondent-State has filed a memo along with a document to indicate the medical status of the petitioner. 6. Memo is taken on record. - 4 -

7. The contents of the said document are read as under:
“With reference to above cited subject in VC Court Session Honorable High Court Judge Dharwad Bench Dharwad Ordered Jail Authorities to submit Recent Health Report of UTP By Name Krishna Chulki. As earlier Mentioned In last Letter of Central Prison Hospital (Medical Certificate) Dated 26/11/2025 Patient Diagnosed With Hypertensive Heart Disease with Left Ventricular Hypertrophy with Resistant Hupertension with Type 2 Diabetes Melitus with Metabolic Syndrome with Hepatomegaly with Skin Alergy. Patient already Undergone Multiple Times Admission in KMCRI Hubli Since 2022 for Hypertensive Emergencies and Taken Treatment. Same Treatment Continued In Central Prison Hospital Dharwad. Recently Patient was Admitted In KMCRI From 03/07/2025 to 09/07/2025 For His Uncontrolled Blood Pressure and Bleeding From Nose. Patient During His Last Consultation at KMCRI Hubli Department of Medicine Unit Doctros Mentioned Patient BP is Persistently High Side Despite Optimal Medical Management and They Referred to Cariology Unit and Nephrology Unit for Further Management.

Kidney Size (Nephromeghaly) and Hupoechoic Parenchyma. Dept of Cardiology Unit Doctors after Examining the Patient Advised to Continue Same Medication And Again Referred to Medicine Unit for Managing Uncontrolled Blood Pressure. Every Day Patient is Monitoring In Central Prison Hospital Dharwad For His Uncontrolled Blood Pressure and Taking Medications for His Various Health Problems. Patient Blood Pressure is Always Above 180/110 mm/hg and Repeatedly Facing Health Problem of Nasal Bleeding and Blurred Vision Because of Uncontrolled Blood Pressure. Patient Required Further Investigation and Higher Treatment for His Uncontrolled Blood Pressure. Below Mentioned Medicines were Taking Everyday By the Patient. Here By Submitting the Patient Recent Health Report for Your Concern and Further Action.”
8. Considering the said health condition of the petitioner, it is appropriate to grant him bail by imposing suitable conditions. 9. Hence, I proceed to pass the following:
ORDER (i) The petition is allowed.

(ii) The petitioner/accused No.4 is ordered to be enlarged on bail in Crime No.112/2019 of respondent-police, on executing personal bond in a sum of Rs.1,00,000/- (Rupees One Lakh Only) with one surety for the likesum to the satisfaction of the Trial Court. (iii) The duration of bail is only for a period of six (6) months from today. (iv) The petitioner shall not threaten or tamper the prosecution witnesses nor hamper the proceedings of the Court. (v) The petitioner shall appear before the Trial Court on all hearing dates without fail. (vi) The petitioner shall not involve in any criminal cases till disposal of the case.
In case, if the petitioner violates any of the bail conditions as stated above, liberty is reserved to the

prosecution to file necessary application for cancellation of bail.
