Heard Sri D.Kishore Kumar, learned counsel for the petitioner, Sri B.V.Satyanarayana, learned Assistant Government Pleader for Stamps and Registration, appearing for respondent Nos.1 to 4. 2.
Learned counsel for the petitioner would submit that the petitioner presented a document dated 17.09.2025 (Ex.P1) before the 3rd respondent.
Learned counsel further submits that the 3rd respondent did not register the said document by following the procedure mandated under the Registration Act, 1908.
3. Learned Assistant Government Pleader, on instructions, would submit that the 3rd respondent received the aforementioned document and assigned P132/2025. Thereafter, an order was passed under Section 71 of the Registration Act, 1908, (hereinafter referred to as ‘Act’,) on 23.09.2025. If the petitioner is aggrieved of, by the said order, the petitioner has to challenge the same by way of appeal under Section 72 of the Act.
4. In reply, learned counsel for the petitioner sought liberty to challenge the endorsement dated 23.09.2025, passed under Section 71 of the Act by the 3rd respondent, before the appellate authority.
5. Given the facts and circumstances the writ petition is disposed of at the stage of admission, with the consent of the counsel appearing on either side, granting liberty to the petitioner to challenge the refusal endorsement dated 23.09.2025, issued by the 3rd respondent under Section 71 of the Act, before the appellate authority. There shall be no order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
