Today the matter has been listed under the caption 'for being mentioned'. 2.Learned counsel appearing for the petitioners brings to the notice of this Court that in paragraph No.2 of page No.2 of the order dated 09.09.2025 made in O.P.No.815 o 2024, address of the deceased Mrs.Hamidunnisa Begam was wrongly mentioned as Tiruvanmiyur, Chennai, instead of Triplicane, Chennai. 3.This Court also perused the records where the address of the deceased was mentioned as Triplicane, Chennai. Therefore, the said typographical error has to be corrected and accordingly, the 2nd paragraph of the said order shall read as follows:-
"2. According to the petitioners, they are the daughters of deceased Mrs. Hamidunnisa Begam, who died intestate on 23.02.2017. The deceased was residing at Triplicane, Chennai. The deceased left the three Bank lockers at SBI Bank, Rajaji Salai Branch, Chennai in Locker Nos.219, 319 and 52. After the demise of their mother, when they approached the said bank requesting permission to operate the lockers, the petitioners were instructed to pay locker rent and to submit a revised Locker agreement. gsa petitioners and the husband of the deceased, Dr. M.A. Hamid, predeceased on 19.01.1975. The value of the securities kept in the lockers is at Rs.1,50,000/-. Since the petitioners are the only legal heirs of the assets and in order to operate bank lockers, the Succession Certificate is necessary to them. Therefore, they have filed this petition." 4.Registry is directed to issue a fresh copy of the order after carrying out the aforesaid amendment.

PRAYER: Original Petition is filed under Part X Section 372 of the Indian Succession Act of 1925 read with Order XXV Rule 6 of the Original Side Rules praying to grant Succession Certificate to the petitioners with power to collect the debts and to receive the interest and dividends on and negotiate and transfer the securities specified in the Schedule. ORDER This petition has been filed by the petitioners praying to grant Succession Certificate under Part X Section 372 of the Indian Succession Act read with Order XXV Rule 6 of the Original Side Rules. 2. After filing of this Original Petition, the petitioners were directed to effect paper publication and the same was also effected. No any objection was received from any party. Thereafter, the matter was posted for examination of witnesses and the evidence was recorded. On the side of the petitioners, they examined PW1 and marked Ex.P.1 to Ex.P15. 4. This Court also perused the entire documents including the evidences. On a careful perusal of the evidence of PW1 and the documents Ex.P.1 to Ex.P15, they reveal that the petitioners are the legal heirs of the deceased Mrs. Hamidunnisa Begam and the deceased died intestate and she had left out three bank Lockers mentioned in the Schedule of the petition and thereby, the petitioners, being the legal heirs, are entitled to operate the https://www.mhc.tn.gov.in/judis
said bank lockers. The petitioners are also stated to have paid the locker rent. Therefore, they are entitled to the Succession Certificate. 5. Considering the averments made in the petition and the documents filed by the petitioners, this Court satisfies that the petitioners have succeeded the Estate of the deceased.
Therefore, this Original Petition is ordered as prayed for and a direction for grant of Succession Certificate in favour of the petitioners with power to collect the debts, securities and to receive the interest and to open the lockers in the presence of the Branch Manager of the Bank specified in the Schedule herein, is issued. 09.09.2025 Index : Yes/No
