...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, this Hon'ble Court may be pleased to issue a Writ, Order or Direction more Particularly one in the Nature of a Writ of Mandamus, the action of the respondents in not regularizing the Services of the Petitioner in his post even though the Petitioner is eligible for regularization by fulfilling the conditions prescribed in A P Regularization of Services of Contract Employees Act 2023 G.O.Ms.No.114 dated 21-10-2023, even though, the 3rd respondent send the Proposal for Regularization vide Rc.No.21796/2006/HR-2, dated 07-02-2025 which was extended to other contract employees who appointed along with the Petitioner and regularized in his services as illegal arbitrary discriminatory and in violation of Article 14, 16, 19 and 21 of the Constitution of India and against the A P Regularization Services of Contract Employees Act 2023 and G.O.Ms. No.114 dated 21-10- 2023 and consequentially direct the Respondent authorities to regularize services of the Petitioner in his posts as on date of 16-03-2024 which was extended to other contract employees who joined service along with the Petitioner by considering his long length of 18 years of service, as per the Apex Court Dharam Singh and other Vs.
State of U.P. and and others (in Civil Appeal No(s)8558/2018 and another Judgment of Apex Court report AIR 2025 Supreme Court Cases 296 (Jaggo Vs Union of India and other. Anita and others Vis Union of India and others) as per the Hon'ble Apex Court
judgment in Secretary State of Karnataka and Ors vs Uma Devi and Ors dated 10-04-2006 with all service emoluments including payment of arrears seniority and other promotional benefits and continue the Petitioner up to 62 years age of Superannuation in accordance Orders dated 08-09-2025 in W.P. No.25700/2024 and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to continue the Petitioner in his present Post up to 62 years in view of the 3rd respondent send the Proposal for Regularization vide Rc.NO.21796/2006/HR-2, dated 07-02-2025 in accordance with A P Regularization of Services of Contract Employees Act 2023 G.O.Ms. No 114 dated 21-10-2023 as per the Orders dated 08-09-2025 in W.P. ORDER:
The present Writ Petition is filed questioning the action of the Respondents authorities in not regularizing the Petitioner in his respective post prescribed in A.P. Regularisation of Services of Contract Employees Act, 2023 and G.O.Ms.No.114, dated 21.10.2023, as illegal and arbitrary.
2. The Petitioner was appointed as Junior Assistant in Forest Department in sanctioned post on contract basis in the year 2007 and the same was extended from time to time and contends that he is entitled for regularisation on par with similarly placed persons in the department.
3. Learned Assistant Government Pleader would submit that as per the policy decision of the government, regularisation proceedings were initiated in the department, but the petitioner could not be regularised in the category of Junior Assistant, as issue is pending before Government/Finance department. It is further stated that vide letter dated 11.04.2025, the Principal Chief Conservator of Forests & Head of Forest Force had furnished details of 21 persons seeking for regularisation on par with similarly placed employees. It is also stated that vide G.O.Ms.No.22 dated 16.03.2024,

regularisation orders were issued to contract employees in forest department.
4. Heard learned counsel for the Petitioner and learned Assistant Government Pleader for the Respondents.
5. Considering the submissions, as the case of the Petitioner is under active consideration for regularisation, the Writ Petition is
disposed of with the following directions: (i) Respondents shall consider the case of the petitioner for regularisation on par with similarly placed employees who were regularised as per G.O.Ms.No.22 EFS & T (SEC-V) department dated 16.03.2024 as expeditiously as possible preferably within three months from the date of receipt of copy of order. (ii) There shall be no order as to costs.
As a sequel, Interlocutory Applications pending, if any, shall stand closed.
