As the case diary is available, therefore, with the consent of the parties, this bail application is heard finally. 3. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No. 152 of 2022, registered at Police Station-Mana Camp, District Raipur 2 (C.G.) for the offence punishable under Sections 394, 397 of the Indian Penal Code and Sections 25 & 27 of the Arms. Act. 4. Case of the prosecution, in brief, is that on 12.06.2022, the applicant alongwith other co-accused persons looted a mobile-phone of the victim and assaulted him with knife. 5. Learned counsel for the applicant submits that the applicant has been arrested on 04.07.2022, till now, more than three years have lapsed but the trial has not been concluded. He also submits that the Co- accused persons namely- Laxminarayan Nagarchi in MCRC No. 6412 of 2024 on 04.10.2024 and Guruvendra @ Golu Nagarchi in MCRC No. 8590 of 2024 on 09.12.2024, have been granted bail by this Court. He submits that as the sufficient time has lapsed and conclusion of trial will take some time, he prays for grant of bail to the applicant. 6. On the other hand, learned State Counsel opposes the bail application. He submits that all the prosecution witnesses have been examined and the matter is posted on 24.11.2025 for recording of the statements of accused persons, therefore, the applicant may not be released on bail. 7. I have heard learned counsel for the parties and perused the case diary. 8. Considering the facts and circumstances of the case and also considering the fact that all the prosecution witnesses have been examined and the matter is in final stages, therefore at this stage, this Court does not find fit to enlarge the applicant on regular bail. 9. Accordingly, the bail application of applicant- Anil Nagarchi 3 involved in Crime No. 152 of 2022 registered at Police Station Mana Camp, District Raipur (C.G.) for the offence punishable under Sections 394, 397 of the Indian Penal Code and Sections 25 & 27 of the Arms. Act, is rejected. 10. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information.
