The petitioner has preferred present writ petition inter-alia with the prayer to quash the order dated 03.01.2025 passed by the District Supply Officer, District Maharajganj/respondent no.4. 3. A preliminary objection has been raised by learned Standing Counsel as well as Shri Sudhir Bharti, learned counsel for the respondent no.5 that against the order impugned statutory alternative remedy is available to the petitioner to file an appeal under Clause 13 (1) of the U.P. Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016. 4. In view of the same, present petition is dismissed on the ground of availability of statutory alternative remedy available to the petitioner. 5. It is made clear that in case an appeal is filed by the petitioner within a period of three weeks from today, the appellate authority will decide the same on merits strictly in accordance with law expeditiously and preferably within a period of three months, thereafter. 6. Office is directed to return certified copy of the order, which are annexed in the present writ petition after keeping photo-copy of the same on record.
