Neutral Citation No. - 2025:AHC:108538 Court No. - 5 Case :- WRIT - A No. - 6886 of 2025 Petitioner :- Akram Ali Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Shrawan Kumar Tripathi Counsel for Respondent :- Anand Kumar Srivastava,C.S.C.,Harshit Pandey Hon'ble Saurabh Shyam Shamshery,J. Heard Sri Shrawan Kumar Tripathi, learned counsel for petitioner and Sri Harshit Pandey, learned counsel for respondent No.4. The prayer of petitioner is being adequately satisfied since during pendency of this writ petition, an amount of about Rs.17 lac has been paid.
Learned counsel for respondent submits that remaining amount of about Rs. 2 lac will be paid within short period.
Learned counsel for petitioner has received instruction and has not disputed the factum of payment of said amount. He further submits that petitioner got retired on 31.11.2024 and above amount is paid recently i.e. after about six months and, therefore, he is entitled for interest at the rate of 18 percent, however, the Court is of opinion that substantial amount is paid within a short period of six months, therefore, present case is not a case where delay, if any, was intentional. The judgments cited are distinguishable on facts since in those cases, dues were paid after more than two years as well as it is also not on record whether petitioner has complied the conditions prescribed in the circular dated 30.09.2009 i.e. whether he has submitted all papers or not. The writ petition is silent on this issue. Accordingly, writ petition is disposed of with an observation that remaining amount of about Rs.2 lac will be paid to petitioner within a very short period, in accordance with law and if it is not paid within one month it will invite interest of 6 % per annum.
