1. The instant petition is for the following reliefs:-
“a) Issue a writ in the nature of Certiorari quashing the Punishment Ticket dated 30.08.2024;
b) Pass any other order or orders, which this Hon'ble Court deems fit and proper in the facts and circumstances of the case and in the interest of justice.”
2. The facts and situation obtained in the instant petition are almost similar to the facts of W.P.(CRL) 3865/2024.
3.
Learned counsel appearing on behalf of the petitioner submits that the petitioner was not served with any notice of surrender. The petitioner could not surrender due to covid-19 situation and thereafter, has voluntarily surrender before the concerned authority. This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 17/08/2026 at 12:06:15
4. The Court, thus, finds that the impugned punishment ticket dated 30.08.2024 would be unsustainable in absence of there being any clear intimation to the petitioner to surrender on a particular date. Therefore, the impugned decision is set aside.
5. Accordingly, the petition stands disposed of.
