1. In the present petition, the petitioner is praying for issuance of a writ in the nature of mandamus directing respondent No.1 not to effect recovery from the salary of the petitioner till the pendency of the statutory appeal dated 12.05.2025 (Annexure P-2) filed by him against the order dated 06.05.2025 (Annexure P-1) passed by respondent No.1 whereby, the recovery has been imposed upon the petitioner.

Learned counsel for the petitioner, on instructions from the petitioner, prays that at this stage, he will be satisfied if a direction may be given to respondent No.2 to decide the appeal filed by the petitioner in a time bound manner by passing a speaking order.

4. Mr. Anil Kumar Sharma, Advocate, accepts notice on behalf of respondents No.1 and 2 and submits that he has no objection to the limited prayer made by learned counsel for the petitioner.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent No.2-the Appellate Authority to consider and decide the appeal dated 12.05.2025 (Annexure P-2), within a period of 06 months from the date of receipt of certified copy of this order, in accordance with law.
6. Since the statutory appeal is still pending and yet to be decided, it will be in the interest of justice that no further recovery be effected from the salary of the petitioner till the disposal of the appeal.
