JUSTICE S G PANDIT) The petitioner who is working as driver in the KKRTC is before this Court complaining disobedience of interim order dated 30.06.2025 whereunder, the order of suspension of the petitioner dated 26.05.2025 was stayed. 2. Heard learned counsel Sri.Ravi Hegde for complainant and learned counsel Sri.Prashanth Hosmani, for accused-respondent and perused the material on record. 3. Learned counsel Sri Prashant S. Hosmani files affidavit dated 16.10.2025 of the accused along with Annexure-R1 to R4. 4. Learned counsel Sri.Prashanth Hosmani would submit that by order dated 05.07.2025, the suspension of the complainant is revoked and he is posted to Koppal Depot. Further, he submits that in view of the revocation of the suspension, the contempt would no more survive for consideration. - 4 - HC-KAR NC: 2025:KHC-D:13971-DB CCC No. 100319 of 2025 5. On the other hand, learned counsel Sri. Ravi Hegde would submit that the accused could not have revoked the suspension, when the interim order of stay was operating staying the order of suspension. Further, to the Court query, whether the complainant has reported to the duty, he submits that since the complainant is posted at Koppal depot, the complainant has not reported. There is no substance in the contention of the learned counsel for the complainant. The authority which passes the order has every authority to modify or withdraw its order. In the instant case, pending enquiry, when the Authority revoked the order of suspension and posted the petitioner to Koppal Depot, the petitioner has no right to stick on to a particular post. It is open for the respondents to transfer the complainant to any other place subject to the relevant statute or regulations governing the transfer. 6. Learned counsel Sri.Ravi Hegde on behalf of the complainant undertook to report to duty at the place of posting within 10 days from today. - 5 - HC-KAR NC: 2025:KHC-D:13971-DB CCC No. 100319 of 2025 7. As we are of the opinion that by virtue of revocation of suspension, there would be no disobedience or contempt of the order of the Court, further proceedings are dropped.
