THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 1120 OF 2025 ORDER:
This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking bail, in Crime No.234/2024 of Palasa p.s., Government Railway Police Vijayawada.
2. A case has been registered against the petitioner for the offence under Section 20(b)(ii)(C) r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act.
3. Case of the prosecution, in brief, is that, on 03.12.2024 at 3.00 pm, on receipt of credible information regarding illegal possession and transportation of ganja, the S.I of GRP, Palasa, along with staff and mediators, started conducting checking at platform no.2 of Palasa Railway station and noticed four persons, and on seeing police, the four persons tried to escape. Then police apprehended one person while the three others escaped. On interrogation, the said person disclosed his identity particulars as A1 and police found 48 kgs of ganja in his possession. Police seized the contraband and arrested the accused and got him remanded to judicial custody on 03.12.2024.

5. Learned Assistant Public Prosecutor submits that investigation is not yet completed and it is at nascent stage, and some more witnesses are to be examined and prays to dismiss the Criminal Petition.

A perusal of the material available on record goes to show that the petitioner/A1 was arrested and remanded to judicial custody on 03.12.2024 and police, on credible information, seized 48 kgs of ganja, which is a huge quantity, from the possession of A1. As stated by the learned Assistant Public Prosecutor that the investigation is at nascent stage. Hence, this Court is not inclined to grant bail to the petitioner at this stage.
7. Accordingly, the Criminal Petition is dismissed.
