The petitioner claims that he was promoted to the post of Karyakari Sahayak and is entitled to time scale benefits. A representation in this regard has been made but to no avail. The only prayer made by Shri Gopal Narayan, learned counsel and Shri Akash Pandey, learned counsels for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time. Shri Jigar Khare, learned counsel holding brief of Shri Kartikeya Saran, learned counsel for the respondent nos. 3 to 4 submits the matter requires factual determination in light of applicable provisions of law by the competent authority in the first instance. However, he fairly contends that the service claim/benefits is liable to be decided within a reasonable time frame. In wake of the preceding discussion and without going into the merits of the case, the respondent no. 5 is directed to decide the representation of the petitioner for grant of time scale benefits in accordance with law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition nor has judged the claim of the petitioners on merit. It is for the competent authority to do so after independent application of mind and in accordance with law. With the aforesaid direction, the writ petition is finally disposed of.
