Prayer in the present petition is for grant of interim bail for a period of 03 months to the petitioner in case bearing FIR No. 275 dated 24.12.2023, registered under Sections, 21, 21-C and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘NDPS Act’) at Police Station Maqboolpura, District Amritsar. 2. Learned counsel for the petitioner has submitted that the petitioner has been booked and detained in the aforesaid FIR and is facing trial. The wife of the petitioner is suffering from serious health problems related to her liver and gall bladder and she is admitted in a hospital for surgery. She needs proper medical as well as personal care, which would only be possible if the petitioner is granted concession of interim bail to take care of her. 3. The factum of admission of wife of the petitioner in hospital and that she is to be operated has been verified by the respondent-State and MOHAMMAD WASEEM ANSARI 2025.05.23 17:23 I attest to the accuracy and integrity of this document CRM-M-27370-2025 (O&M) -2- the same has been found to be true. However, it is submitted by learned State counsel that there are chances of the petitioner’s absconding if he is released on interim bail. Hence, the dismissal of the petition is prayed for. 4. I have heard learned counsel for the parties at considerable and have also gone through the record carefully. 5. Admittedly, the wife of the petitioner is admitted in a hospital and she is to undergo a surgery relating to her liver and gall bladder. She needs proper medical and personal care, for which, the presence of the petitioner with her is obviously required. Keeping in view the aforesaid facts, this Court is of the considered opinion that no prejudice will be caused to the respondent-State or any other party in case the petitioner is released on interim bail for a limited period in order to enable him to take care of her pregnant wife. Accordingly, without going into the merits of the case and strictly for the aforesaid purpose, the present petition is disposed of and the petitioner is ordered to be released on interim bail for a period of 15 days, subject to his furnishing personal bonds and two surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned. It is made clear that the petitioner shall surrender before the jail authorities on 09.06.2025 by 05:00 PM, without fail. 6.
