The present writ petition has been filed praying for a mandamus commanding the District Magistrate, District Kaushambi and the Mining Officer, District Kaushambi to decide the representation dated 29.4.2025 filed by the petitioner claiming compensation for illegal digging / extraction of mud from his Plot No. 5A area 3.7560 hectare, situated at Kuti Palhana Ghat, Police Station Sandipanghat, Pargana Chail, Tehsil Chail, District Kaushambi by respondent no. 5 who is the agent of the State respondents. It would serve no useful purpose to keep the writ petition pending. The writ petition is disposed of with a direction that in case, the petitioner files a fresh representation within two weeks from today along with all the necessary documents, the District Magistrate, District Kaushambi shall consider his representation and decide the same within one month from the date of filling the representation. In case, the allegation of the petitioner is found to be true, the District Magistrate, District Kaushambi shall take consequential actions as permissible under the law for payment of compensation to the petitioner either from the State exchequer or from the respondent no. 5 within one month from the date of decision on the representation of the petitioner.
