“It is, therefore, prayed that this Hon’ble Court may kindly be pleased to quash the criminal case cognizance order dated 07.08.2025 passed by the learned Judicial Magistrate First Class, Raipur, District Raipur (C.G.) in Criminal Case No. 29833 of 2025 along with charge-sheet No. 93 of 2025 dated 03.08.2025 and Crime No. 128 of 2025 dated 20.07.2025 registered at Police Station Devendra Nagar, District Raipur (C.G.) for the offence punishable under Section 34(1) of Chhattisgarh Excise Act against the applicant, in the interest of justice.”

The present petition has been filed by Mr. Thakur Nishchaya Singh, learned counsel for the petitioner, who has submitted a composite Vakalatnama along with Ms. Palak Miglani and Mr. Rajesh Kumar Singh Chouhan, Advocates. However, none of the said counsel are present to press the petition when the matter is called out. 3. Upon a pointed query being put to Mr. Ravikar Patel, learned counsel holding the brief of Mr. Thakur Nishchaya Singh, as to the absence of the said counsel, he submits that he is unaware of their whereabouts and that the brief was handed over to him belatedly. He further submits that he is not prepared in the matter. From a perusal of the record, it is evident that Mr. Ravikar Patel does not have the authority to represent the petitioner, and the three counsel who are duly
3 authorized through the Vakalatnama are absent. In these circumstances, the present petition cannot be proceeded with. 4. Accordingly, the present petition is dismissed for want of prosecution.
