Mr. Sudeep Singh, counsel for petitioner, fairly states that since the suit before the Trial Court is at an advanced stage, they are not pressing this petition, which challenges the dismissal of the application filed under Order XII Rule 6 of the Code of Civil Procedure, 1908 [‘CPC’]. 2. Mr. Sudeep Singh, counsel for petitioner, seeks liberty to raise these issues before the Trial Court during final arguments. 3. In this light of the matter, considering that withdrawal with liberty is being requested, the observations of the Trial Court contained in the impugned order may not come in the way while deliberating upon the final arguments raised by parties. 4. Accordingly, the petition is dismissed as withdrawn. 5. The aforesaid liberty is granted. This is a digitally signed order.
