ORAL ORDER (PER: THE HON'BLE MR. JUSTICE M.NAGAPRASANNA)
1. The petitioner is before this Court seeking the following prayer:
I. Writ in the nature of certiorari, quashing impugned endorsement dated 16-07-2025 issued by the respondent authority in No.Pu Sa Hu/ Janana- Marana/ Himbarah/ 2025-26, as per Annexure-F.
II. Writ in the nature of mandamus, directing the respondent authority to enter the name of the petitioner in Column No. 7 as wife of the deceased in the Death Certificate Late Chandrasekarappa Halapeti;
III. Any other appropriate writ, order or direction as deemed fit and proper be issued, in the interest of justice and equity. 2. The petitioner is said to be the legally wedded wife of one Chandrasekharappa Halapeti. The petitioner submits an application for entry of her name as the wife of the deceased in the death certificate before the Registrar of Registration of Births and Deaths Act, 1969 in the Town Municipal Council. 3.
The said application comes to be rejected on the score that a death certificate has already been drawn long ago and the wife's name is shown as blank, as no person was indicated in the application. - 3 -

4. The learned counsel for the petitioner submits that the deceased had two wives. The two wives were before the concerned Civil Court in O.S.No.398 of 2024, for a declaration as to who is the legally wedded wife in the said suit, is compromised. The terms of compromise are as follows:

ªÁ¢ ªÀÄvÀÄÛ ¥ÀæwªÁ¢AiÀÄgÀÄ vÀªÀÄä vÀªÀÄä ¥ÀæPÀgÀtzÀ RZÀð£ÀÄß vÁªÉà ¨sÀj¸À®Ä M¦àgÀÄvÁÛgÉ.”
5. The suit is decreed on the strength of the said compromise. The compromise clearly indicates that the present petitioner is the legally wedded one. 6. In the light of the compromise and the decree drawn by the competent Civil Court, the TMC now cannot deny the entry of the name of the petitioner as the wife of the deceased in the death certificate. - 5 -

7. The impediment projected by Sri.J.S.Shetty, the
learned counsel appearing to the respondent is that, once the death certificate is issued, the same cannot be incurred by including the name or excluding the name.

In the light of the aforesaid circumstance, I deem it appropriate to direct the competent authority under the Registrar of Births and Deaths of the TMS, to act in accordance with the compromise and redeem the grievance of the petitioner by entering the name into the death certificate as being the wife of the deceased.
9. In the teeth of the said compromise, while so doing, it is open to the respondent to solicit any other document that would be needed for the needful action.
10. For the aforesaid reasons, the following:
ORDER i. Petition is allowed. ii. The impugned endorsement dated 16-07-2025 issued by the respondent Authority stands quashed

iii. Mandamus issues to the Authority to bear in mind the observations in the course of the order and pass necessary orders upon it. iv. The actions will be taken within 12 weeks from the date of receipt of copy of the order.
