1. The petitioner Rama Bai has filed this writ petition under Article 226 of the Constitution of India against inaction of the respondents for not releasing family pension to the petitioner of her husband Rama.
2. Mr. Tiwari, learned counsel for the respondents would submit that in the service record name of Rama’s wife Fulwanta has been MANISH YADAV Digitally signed by MANISH YADAV Date: 2025.12.19 11:17:35 +0530
2 mentioned, as such there is dispute who is legally wedded wife of which cannot be adjudicated in this Court while hearing the writ petition under Article 226 of the Constitution of India. Thus, he would pray for dismissal of the writ petition.
3. I have heard learned counsel for the parties and perused the writ petition with utmost circumspection.
4. Considering the fact that there is dispute about the identification of the wife of Late Rama which can be adjudicated before the competent Civil Court, therefore, the writ petition is disposed of granting liberty to the petitioner to take remedy available to her under the Civil law.
5. With aforesaid observation, the present writ petition is disposed of granting liberty in favour of the petitioner.
