Learned counsel for the petitioner, Ms. Kamei Lungchuithailiu is present before this Court physically; learned counsel for the respondent No. 1, Mr. N. Zequeson and learned CGSC for the respondent No. 2 are also present before this Court physically. The present contempt proceeding has been initiated for willful disobedience of the order dated 21.01.2022 rendered by the Ld. Single Judge passed in W.P.(C) No. 635 of 2020. The learned counsel appearing for the respondent No. 1 submits that he has already filed compliance affidavit dated 13.12.2023 consisting of para No. 1 to 12 wherein, para No. 11 of the compliance affidavit reveals that necessary step has been taken up for compliance of the order and direction of the Hon’ble Court. When the present contempt petition has been filed on 06.02.2023, the period of 3 (three) months prescribed in the order dated 21.01.2022 passed in the aforesaid writ proceeding, wherein necessary order for joint survey was already issued on 06.04.2023 and the survey was carried out on 08.04.2023. was delay in submission of the joint survey report which has been occasioned for no fault of the answering deponent but on account of unavoidable circumstances stated hereinabove. Therefore, the deponent in this compliance affidavit in the rank of respondent No. 1 is submitting that he has no intention to disobey the direction rendered by the Ld. Single Judge in the aforesaid writ proceeding and therefore, seeking for closing of this contempt petition. Whereas, the learned CGSC for the respondent No. 2 submits that he has also filed compliance affidavit consisting of para No. 1 to 5, wherein para No. 3 reveals that in the joint survey conducted by the SDC Waikhong and Forest Department and based on the enquiry report vide letter No. 77/SDC(WKG)/1.R/2018 dated 01.12.2022, it is found that there is no recognized village called Kaziphung village within the jurisdiction of Kakching Revenue District.
However, based on the schedule of village/land so claimed by the petitioner, it is found that the so called Kaziphung village lies under Thongam Mondum Reserved Forest. Therefore, keeping in view of the compliance affidavits filed by the respondents No. 1 & 2, it is deemed appropriate that this contempt proceeding does not survive for consideration.
