The petitioner has assailed a demand notice issued to him by the respondent, Development Authority, for deposit of certain charges to enable it to consider sanction of a building plan submitted by the petitioner. 2. Submission is that various charges sought to be imposed thereby are contrary to the law laid down by Supreme Court in Mathura Vrindavan Development Authority and another Vs. Rajesh Sharma and others reported in AIR 2023 SC 2957. Learned counsel for the petitioner submits that the petitioner has already represented in this regard before the Vice Chairman, Ghaziabad Development Authority, Ghaziabad vide representation dated 29.04.2025. He submits that the same be directed to be decided in the light of the aforesaid judgment of the Supreme Court. 3. Shri Tejasvi Mishra, learned counsel for the respondent, Development Authority, submits that the Development Authority will revise the demand keeping in mind the representation of the petitioner and the law laid down by the Supreme Court in Mathura Vrindavan Development Authority (supra). 4. Accordingly, the petition stands disposed of with direction to the respondent, Development Authority, to issue revised demand notice keeping in mind the law laid down by Supreme Court in Mathura Vrindavan Development Authority (supra) and the representation of the petitioner dated 29.04.2025 within four weeks from today.
